Summary Judgment on all claims was awarded to Ricci Tyrrell client Jesco Iron Craft (Jesco)in a death action pending in the New York Supreme Court – County of Bronx.
Jesco was allegedly the manufacturer of an industrial cart which tipped over on top of decedent. The Court found Jesco met its prima facie burden to prevail on summary judgment against claims that the cart was defectively designed and was provided with inadequate warnings. There was a significant question over product identification, as well as evidence the cart was overloaded at the time of the accident which was appreciated by those involved in the work process.
Summary Judgment was achieved by a team led by RTJG Managing Member John Tyrrell. Member Jackie Zoller authored the briefs, and associate Rich Chesney argued the motion.
